Terms of Service

1. Agreement

These Terms of Service ("Terms") are a binding agreement between you and QuickStudy ("QuickStudy," "we," "us"). By creating an account or using the app or website (the "Service"), you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years old to use the Service, and at least 18 (or the age of majority where you live) to purchase a subscription. By using the Service you represent that you meet these requirements and that the information you provide is accurate.

3. Educational use only, NOT medical or professional advice

QuickStudy is a study and test-preparation tool. Its questions, rationales, flashcards, case studies, AI explanations, readiness scores, and all other content are provided for educational purposes only. They are not medical advice, not clinical guidance, and not a substitute for professional judgment, your instructors, your program's materials, current clinical guidelines, or the direction of a licensed clinician.

Never use the Service to make real patient-care, diagnostic, medication, or treatment decisions. Always verify any clinical fact against authoritative, current sources and your institution's protocols before acting on it in practice.

4. No guarantee of accuracy, outcomes, or exam success

We work hard to verify content against current guidelines, but we do not warrantthat any content is accurate, complete, current, or error-free, and guidelines change. Content may contain errors or become outdated.

We make no guarantee that using the Service will improve your grades, that you will pass the NCLEX or any exam, or that any "readiness" indicator predicts an actual outcome. Any pass rates, testimonials, or projections are not promises of results.

5. Your account and conduct

You are responsible for your account and for activity under it. You agree not to: misuse or disrupt the Service; scrape, copy, resell, or redistribute our content; reverse-engineer the Service; upload unlawful, infringing, or others' confidential information (including real patient data, do not upload protected health information); or use the Service to build a competing product.

6. Your uploads

If you upload syllabi, notes, or other material, you represent you have the right to do so and you grant us a limited license to process that material to provide the Service to you. Do not upload real patient-identifiable information.

7. Intellectual property

The Service and its content (excluding your uploads) are owned by QuickStudy and protected by law. We grant you a personal, non-transferable, revocable license to use the Service for your own study. All other rights are reserved.

8. Subscriptions, billing, and refunds

Paid features are billed through our payment processor on the plan you select and renew automatically until cancelled. You can cancel anytime; cancellation stops future renewals but does not retroactively refund the current period except where required by law. Prices may change with notice.

9. Third-party services

The Service relies on third parties (for authentication, hosting, database, and AI features). Your use may be subject to their terms, and we are not responsible for third-party services.

10. Disclaimer of warranties

THE SERVICE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, QUICKSTUDY AND ITS FOUNDERS, OFFICERS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, ACADEMIC OR PROFESSIONAL STANDING, OR ANY HARM ARISING FROM CLINICAL DECISIONS, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER THEORY. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 3 MONTHS BEFORE THE CLAIM OR (B) US$50.

12. Indemnification

You agree to indemnify and hold QuickStudy harmless from claims, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your uploads, your violation of these Terms, or your reliance on Service content in any real-world setting.

13. Arbitration and class-action waiver

Any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration, not in court, except that either party may bring qualifying claims in small claims court. You and QuickStudy waive any right to a jury trial and to participate in a class or representative action. You may opt out of arbitration within 30 days of first accepting these Terms by emailing us.

14. Governing law

These Terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-laws rules.

15. Changes and termination

We may update these Terms; material changes will be posted here with a new effective date, and continued use means acceptance. We may suspend or terminate access for any violation.
